This service is jointly operated by Lynher Valley Partnership and Antony Hospitality Holding (collectively referred to as ‘we’, ‘us’, or ‘the Joint Controllers’). Both entities act as joint controllers for the processing of your personal data related to this business.

1. Introduction

We are committed to protecting your privacy and managing your personal data transparently, securely, and in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Please note that under the UK GDPR, personal data relates strictly to living individuals; information concerning deceased individuals falls outside the scope of data protection legislation, though it remains governed by common law confidentiality, estate law, and our ethical retention policies.

Arranging a funeral or securing a final resting place is a deeply personal process. This privacy notice explains what personal information we collect, how we use it, how long we retain it, and the legal basis for doing so when you interact with Churchtown Natural Burial Ground.

2. Who we are (data controller)

The Antony Hospitality Holdings and Lynher Valley Partnership are the Joint Data Controllers for all personal data processed in relation to Churchtown Natural Burial Ground.

3. What personal data we collect

We collect and process personal data relating to Plot Purchasers (Right of Burial holders), applicants, deceased individuals, next of kin, and contractors (such as Funeral Directors and Grave Diggers).

This information may include:

  • Contact Information: Name, postal address, telephone number, and email address.
  • Deceased Records: Full name, date of birth, date of death, last known address, and gender of the deceased.
  • Official Certifications: Copies of the Burial/Cremation Certificate (Green Form or Coroner’s Order for Burial) required by law before a burial can take place.
  • Plot Ownership Records: Information linked to the purchase, allocation, mapping of specific natural burial plots.
  • Financial Information: Payment records processed securely for burial plots and estate administration fees.
  • Correspondence: Information provided when you contact the Estate Office regarding plot maintenance, wildflower seeding, or visiting arrangements.
  • Lynher Valley Partnership are responsible for collecting and processing data around advance purchased Right of Burials and in relation to the maintenance endowment fund.
  • Antony Hospitality Holdings are responsible for the data relating to the act of burial itself.

4. How we collect your data

We collect personal data in two primary ways:

  • Directly from you: When you apply to purchase a plot, arrange a burial, or update your contact details with the Estate Office.
  • Via Third Parties: Typically from your chosen Funeral Director when they submit an application for interment or handle arrangements on your behalf.

5. Why we use your information (lawful basis for processing)

Under the UK GDPR, we process your information using the following legal bases:

  • Performance of a Contract: To fulfil our contractual agreement with you to provide, map, and preserve a natural burial plot.
  • Compliance with a Legal Obligation: To process mandatory government registry details regarding burials and to comply with tax, financial auditing, and health and safety legislation.
  • Legitimate Interests: To maintain accurate, long-term records of who is buried on our land, which is essential for the ongoing environmental conservation, safety, and operational management of the Churchtown site.

6. Sharing your data

We respect your privacy and will never sell or share your data with third parties for marketing purposes. To run the burial ground effectively, we share relevant data only with:

  • Funeral Directors & Grave Diggers: To safely coordinate the scheduling, logistics, and physical requirements of the burial.
  • Land Partners / Conservation Bodies: Where necessary for the long-term conservation and habitat management of the land (e.g., coordinating wildflower management or tree planting), ensuring all identifying personal information is kept to a strict minimum.
  • Saltash Town Council (Shared Facilities): Basic logistical scheduling information may be shared to facilitate the permitted use of nearby facilities (such as the adjacent car park booking system) to prevent scheduling overlaps.
  • Monument Stone Masons: if a memorial disk is purchased, data strictly required for delivery of the monument will be shared with approved stone masons.

7. How long we keep your data

  • Burial & Mapping Registers: Records of interments and exact grave locations are kept permanently. This ensures the long-term integrity of the natural burial ground, prevents accidental disturbance of plots, and preserves historical records for the estate’s lifetime.
  • Ownership & Contact Details: Contact details for plot purchasers are kept for the duration of our operational relationship with you, plus a standard statutory limitation period to handle any future estate or legal queries.
  • Financial Records: Retained for 6 years plus the current financial year in line with standard UK commercial tax and auditing guidelines.

8. Your rights

Under UK data protection law, you have specific rights regarding your personal data:

  • Right of Access: You can request a copy of the personal information the Estate holds about you.
  • Right to Rectification: You can ask us to correct inaccurate or incomplete data. (Plot owners are strongly encouraged to keep their contact details updated so the Estate can reach them regarding any long-term land management updates).
  • Right to Restriction: You can ask us to restrict processing under certain circumstances.
  • Right to Erasure (“Right to be Forgotten”): You can request the erasure of your personal data where it is no longer required for contractual, financial, or critical mapping purposes. Please note we cannot erase historical burial mapping logs as these are critical to the safe physical management of the land.

To exercise any of these rights, please contact the Estate Office using the details in section 2. You also have the right to lodge a complaint with the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection, at ico.org.uk. We would, however, appreciate the chance to address your concerns first.

9. Changes to this policy

The Joint Controllers may update this privacy notice from time to time to reflect operational updates or changes in data protection legislation. The latest version will always be available on our website.
