Terms of sale
Last updated: a draft, pending review.
These terms apply when you reserve and pay for a Right of Burial at Churchtown Natural Burial Ground through this website. Please read them before you place an order — by completing the reservation and payment you agree to them. They do not affect your statutory rights as a consumer.
They sit alongside our site rules and information, which set out how the burial ground is run — including memorials, coffins and shrouds, and how graves are prepared. Where these sale terms and that information differ, please contact us and we will explain.
1. Who you are buying from
The burial ground is operated by Antony Hospitality Holdings and Lynher Valley Partnership, trading as Churchtown Natural Burial Ground. Antony Hospitality Holdings is a company registered in England and Wales (company number 09959797); Lynher Valley Partnership is a partnership. The land is held under freehold tenure by the Antony Estate.
You can reach us on 01752 922616 or at hello@churchtownburials.com. Our address for orders and correspondence is: Churchtown Farm Natural Burial Ground, Churchtown Farm, Farm Lane, Saltash, Cornwall, PL12 4AR.
2. What you are buying
A reservation buys the Right of Burial in a chosen plot — the right to have a burial or interment of ashes take place there in the future. It is a right in respect of the plot; it does not transfer ownership of the land.
- Pre-purchased Rights of Burial are granted for 20 years. We will contact you towards the end of that period to confirm the plot is still required. A £1 administration fee applies to reissue your Right of Burial Certificate.
- Plots are single-depth. A second, adjacent plot may be reserved at the same time and will be placed side by side.
- Pre-purchased plots are non-transferable. At a time of need the surviving owner may choose to give the plot to someone else; the Right of Burial is then complete when that person is laid to rest. The Right of Burial cannot be transferred after the owner’s death.
- The interment fee is not part of this purchase. It is paid separately, at the time of a burial or interment of ashes, at the rate then in force.
3. How your order is made and accepted
When you complete the reservation form and pay, you are making an offer to buy a Right of Burial. Your order is not accepted straight away. A contract between us comes into being only when we confirm your reservation to you in writing (by email) and issue, or arrange to issue, your Right of Burial Certificate.
We may be unable to accept an order — for example, if the plot is no longer available, if there has been an error in the price or description, or if we are unable to confirm your details. If we cannot accept your order we will tell you and refund any payment in full as soon as possible.
4. Price and payment
- The price you pay is the total shown on the reservation summary at the time you order. This is the Right of Burial fee together with the 90-year maintenance contribution, which is included with every plot.
- Prices shown elsewhere on this site are indicative and reviewed from time to time. The price that applies to your order is the one confirmed at checkout.
- Payment is taken online by card through Stripe, our payment provider. Your card details are handled securely by Stripe and are never seen or stored by us.
- Our fees for the Right of Burial and interment are not subject to VAT [VAT treatment to be confirmed with your accountant — burial is generally VAT-exempt, but memorial markers may be standard-rated].
5. Your right to cancel (14-day cooling-off period)
Because you are buying online, you have the right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You may cancel within 14 days without giving any reason. The period ends 14 days after the day we confirm your reservation.
To cancel, simply tell us before the 14 days are up — by email to hello@churchtownburials.com, by phone on 01752 922616, or by post to the address above. You can use the form at the end of these terms, but you do not have to. To meet the deadline it is enough to send your message before the cancellation period ends.
If you cancel in time we will refund all payments received from you, using the same means of payment you used, within 14 days of being told. There is no charge for cancelling within this period, as no burial or interment will have taken place.
6. Changing or ending your reservation later
After the 14-day cooling-off period the Right of Burial fee and maintenance contribution are non-refundable. If you later decide you no longer require the plot, please let us know in writing. You may transfer the plot during your lifetime as described in section 2; otherwise it will be returned to us so that it can be offered to another family.
If your circumstances change and you would like to discuss your reservation, please contact us — we will always try to help.
7. Using the plot
Burials and interments at Churchtown are carried out in keeping with the natural setting. In particular: we cannot accept embalmed remains; coffins, shrouds and their liners, pillows, handles and hinges must be biodegradable; large American-style coffins are not permitted; and memorials are limited to the simple plaques we provide, placed once the ground has settled. Full details are on our site information page, which forms part of your agreement with us.
8. Our responsibilities to you
We will provide the Right of Burial with reasonable care and in line with the information published on this site. Nothing in these terms limits your legal rights as a consumer, and nothing excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law. Subject to that, we are not responsible for losses that were not foreseeable or that arise from circumstances beyond our reasonable control.
9. Your information
We use the details you give us to manage your reservation and the burial ground. We explain how in our privacy notice.
10. Complaints
If something is not right, please tell us on 01752 922616 or at hello@churchtownburials.com and we will do our best to put it right. As members of the Association of Natural Burial Grounds we follow its Code of Conduct.
11. General
We may update these terms from time to time; the version that applies to your order is the one in force when you placed it. These terms are governed by the law of England and Wales, and disputes may be dealt with by the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the country where you live.
